INFORMATION CLAUSE

  1. In accordance with Article 13(1) of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons in relation to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (hereinafter: GDPR), we inform you that the Administrator of your personal data is Meissner Kozioł Kaczmarek & Partner spółka komandytowa with its registered office in Poznań (60-279) at ul. Palacza 144, entered in the register of entrepreneurs under KRS number: 0000529688, REGON: 302862245, NIP: 7831718502, hereinafter: the “Administrator”.
  2. The Administrator processes your personal data on the basis of:
    1. Article 6(1)(a) of the GDPR – the data subject has given consent to the processing of his or her personal data for one or more specific purposes;
    2. Article 6(1)(b) of the GDPR – processing is necessary for the performance of a contract to which the data subject is party or in order to take steps at the request of the data subject prior to entering into a contract;
    3. Article 6(1)(c) of the GDPR – processing is necessary for compliance with a legal obligation to which the controller is subject;
    4. Article 6(1)(f) RODO – processing is necessary for the purposes of the legitimate interests pursued by the controller or by a third party, except where such interests are overridden by the interests or fundamental rights and freedoms of the data subject which require protection of personal data, in particular where the data subject is a child;
    5. Article 9(2)(a) of the DPA – on the basis and to the extent of your consent if you have given your consent and the data provided by you is sensitive data;
    6. Article 9(2)(f) RODO – in the case of transferring sensitive data to the Administrator in order to assert your claims to the extent necessary to establish, assert or defend these claims.
  3. The Administrator processes the following personal data: first and last name, date of birth, address of residence (address for correspondence), PESEL number. Depending on the nature and purpose of the concluded contract, the Administrator may also process other personal data provided by you, including: the number and series of your identity card, health data (in particular relating to the injury suffered), nationality, age, address of residence, NIP, REGON, marital status data, telephone number, e-mail address, as well as any other data required by generally applicable laws or necessary for the proper performance of the contract concluded by you with the Administrator.
  4. The personal data you provide shall be stored for:
    1. the duration of the contract, or
    2. the period necessary for the performance of the Administrator’s legal obligations, or
    3. the period necessary to establish, assert or defend your claims, or
    4. the period necessary to carry out the activities for which you have given your consent, or;
    5. the period necessary to pursue the Administrator’s legitimate interests,

and also for the time required by generally applicable law.

  1. The recipient of your personal data is the Administrator and persons authorised to process personal data on its behalf, as well as entities with whom the Administrator has entered into an agreement on the entrustment of personal data processing.
  2. The Administrator may make your personal data available to entities with which he concluded an agreement on entrusting the processing of personal data, including entities supporting him in the field of financial and accounting services, IT and courier services. In connection with the provision of legal assistance, the Administrator may make your personal data available to courts and public administration bodies, if this is required by the proper performance of the contract.
  3. We inform you that you have the right to access the personal data provided, the right to rectify, complete, erase, limit processing, transfer to another data controller (within the scope of Article 20 of the GDPR) and the right to object to the processing of personal data and to lodge a complaint with the President of the Office for Personal Data Protection in the event that you consider that the processing of personal data violates the provisions of the GDPR. You also have the right to withdraw your consent to the processing of personal data at any time without affecting the legality of the processing which was carried out on the basis of consent before its withdrawal.
  4. Your personal data will not be transferred to a third country within the meaning of the GDPR or to an international organisation.
  5. your personal data will not be processed by automated means.
  6. providing your personal data is a prerequisite for concluding a contract with the Administrator and is necessary for its execution.
